I. General Provisions and Definitions
These Terms and Conditions (hereinafter: “T&C”) set out the rules for purchasing tickets and participating in events and workshops as part of the Gotango Poznań Festival (hereinafter: “Festival”).
The operator of the gotangofestival.com website and the sales system is Gotango sp. z o.o., with its registered office in Poznań (60-195), 18 Jana Brzechwy Street, KRS: 0000716861, NIP: 7792480946 (hereinafter: “Operator”).
The organizers of individual events within the Festival are:
Gotango sp. z o.o. (details as above),
Fundacja La Vita Arte, with its registered office in Poznań (60-116), 3 Głazowa Street, KRS: 0000865323, NIP: 7792520812.
Information regarding which of the entities listed in point 3 is the organizer (hereinafter: “Organizer”) and the seller of the ticket for a given event is always clearly indicated on the event page and in the shopping cart summary. In the case of tickets sold by Fundacja La Vita Arte, the Operator acts solely as an intermediary (agent) facilitating the conclusion of the contract.
II. Ticket Purchase and Refunds
The right to participate in events and workshops is granted exclusively to individuals who purchase valid tickets.
Ticket sales are conducted via:
the gotangofestival.com website,
stationary box offices of partners: CK Zamek, CIK Poznań,
the partner portal: bilety24.pl.
The ticket price covers only the right to participate in a given event/workshop. All other expenses (accommodation, food, travel, insurance) are borne by the Participant.
Pursuant to Article 38(12) of the Polish Consumer Rights Act, the right to withdraw from an off-premises or distance contract does not apply to consumers in respect of contracts for the provision of services related to leisure, entertainment, or cultural events, if the contract specifies the day or period of service provision. This means that tickets are non-refundable, except in the case of event cancellation.
The Participant has the right to freely resell or transfer the ticket to another person (find a replacement) without the need to inform the Operator. The ticket is treated as a bearer ticket, granting single entry – which means that in the event of its duplication or multiple transfers, admission will be granted to the first person who presents it at the ticket control.
In the event of the cancellation of the Festival or a specific event/workshop, payments for tickets to that event will be fully refunded to the Participants within 14 days.
III. Rules of Participation
The number of places for each event is limited. Individuals who have not paid for participation are strictly prohibited from staying in workshop rooms and ticketed areas.
The Organizer reserves the right to make changes to the program, artistic lineup, and schedule due to circumstances beyond their control. Updates will be published on the website and the Festival’s social media channels.
A strict no-smoking policy applies in all Festival venues (except in designated areas). Participants must strictly adhere to the regulations of the venues where events are held (e.g., CK Zamek).
The Organizer reserves the right to refuse entry to an event or expel a person whose behavior poses a threat to other participants, violates good manners, or breaches venue regulations (including being visibly under the influence of alcohol or intoxicants).
Participants bear full financial responsibility for damages caused by them to the property of the Organizer, partners (e.g., venues), or other participants. The Organizer is not liable for property left behind or lost by participants; therefore, it is recommended to use the cloakroom and not leave valuable items unattended.
IV. Image and Copyright
The Festival is a public space. By participating in the events, the Participant acknowledges that their image may be captured in photographs or video recordings as part of a larger whole (crowd, audience, dance floor) in accordance with Article 81(2)(2) of the Polish Act on Copyright and Related Rights.
These materials may be used by the Operator and Organizers for the purpose of reporting on the event and promoting future editions of the Festival.
Commercial recording or other forms of capturing dance classes without obtaining the prior written consent of the Organizer or the consent of the instructors is strictly prohibited.
In accordance with the requirements of the General Data Protection Regulation (GDPR), we inform you about how we process your data:
1. Who is the Data Controller? The main Controller of Personal Data provided through the gotangofestival.com website, as well as via email correspondence to gotangofestival@gmail.com and info@gotangofestival.com, is Gotango sp. z o.o., with its registered office in Poznań (60-195), 18 Jana Brzechwy Street, NIP 7792480946. In the case of purchasing tickets for events organized by Fundacja La Vita Arte (which is indicated in the shopping cart), your data necessary to process the order is shared with them, and the Foundation becomes an independent data controller for the purpose of managing that event. 2. Purpose and Legal Basis for Processing We process your data (name, surname, e-mail address) for the following purposes:
Conclusion and performance of a contract (Article 6(1)(b) GDPR) – i.e., ticket sales, sending organizational information, and managing entry to events.
Fulfillment of legal and tax obligations (Article 6(1)(c) GDPR) – accounting for payments and issuing accounting documents.
Direct marketing and newsletter (Article 6(1)(a) GDPR) – allowing us to inform you about future editions of the Festival.
Legitimate interest (Article 6(1)(f) GDPR) – e.g., potential establishment, exercise, or defense of legal claims.
3. Data Recipients Due to our cooperation with technical partners, your data may be transferred to entities processing it on our behalf (so-called data processors), such as: payment operators (e.g., Stripe, Przelewy24), accounting offices, and hosting or mailing service providers. Data may be transferred to public authorities only by virtue of applicable law. We do not use your data for automated decision-making (profiling).
4. Data Retention Period Your data related to ticket purchases is processed for the duration of the event, and subsequently for the period required by tax law (standardly 5 years). We will process your email address so that you can receive information about future editions until you withdraw your consent.
5. Your Rights At any time, you have the right to:
access your data and receive a copy of it,
rectify (correct) your data,
erase or restrict processing (in situations provided by law),
withdraw consent to marketing activities at any time (without affecting the lawfulness of processing based on consent before its withdrawal),
lodge a complaint with the President of the Personal Data Protection Office (PUODO) if you consider that the processing violates GDPR regulations.
